It’s a street address and business is transacted (tenants walk-in checks, notary service, send/receive mail, etc.). : Do you care to speculate on the consequences of using other than a “business address” as defined by CC1695? If the consequences are small and the probability of being found in violation is low, maybe it’s worth taking the hit. I’m not crazy about the idea of a foreclosure seller showing up at my home. : Is there any value in having the seller sign a statement acknowledging that he was given the opportunity to cancel and decided to proceed, maybe this could be done at the time of signing the deed? This might be a CYA for the business address issue and other claims that he tried to cancel and couldn’t. Or is this over-the-top? : David
1) if your that worried about giving out your home address you should probably rent a small office space for a couple hundred bucks a month, this in the long run would probably be cheaper than the "low chance" of a 1695 violation being discovered against you. 2) if the homeowner is disgruntled enough to come to your "address" and discoveres it is just a mail box etc, this will probably just escalate his irritation and increase the chances of discovering some violatoin of 1695. 3) I dont like the idea of an equity seller coming to my home either, thats why I use a small cheap office space, its tax deductable, and for the small expense gives you alot of peace of mind. Cutting too many corners will come back to haunt you one day, its especially not worth it when the consequences can be heafty fines and punishments.
