Okay, then . . .

Is your deed recorded? If so, the former owner can't now encumber your property. So if the lender didn't record, I don't think they now can.

I'd like to see the former owner out of there entirely. I don't like the idea of remortgaging, advising, and then negotiating. That's not how the game is played and you'll look like a sharpie.

And don't forget, at some point they come looking for the seller to collect their money, even if the seller no longer owns the thing.

I might buy it and sell it, but I wouldn't spend the money and I'd make sure the seller signs a disclosure statement acknowledging the possibility of a large problem out in the future.

. . . and I'd have a good attorney waiting in the wings . . .
