Yet we have not gotten a penny of the $5000.00 that was suppose to be on the land contract we are holding. I want to foreclose but I am not sure what the procedures are here in the state of Michigan. I can't really afford an attorney seeing my husband was layed off after 28 years of work. We could use the money or we would like to re-sell the land. I read of a statutory foreclosure, the contract was not recorded other than they went to a local township hall to get the tax bill put in their name and forwarded to their prior address. Can you help me or give me information on what to do... Thank you for your time.

Joanna, I don’t suggest that people seek out an attorney unless the facts really seem to merit one. And this is one of those times. I think you need to take your story, your agreements, and your property file to an attorney to get things sorted out. I for one don’t know what your rights might be vis a vis any enforceable mortgage or land contract.

If I were in your shoes I would call your local title company and ask for a list of attorneys they could recommend who specialize in mortgage law.
