I sold them the land very cheep with the ideal they were going to build a home on it and help in a business venture of horses. They agreed to make payments and put their home on market to sale. We made a special addendum that allowed them to keep $5000.00 of the down payment and pay it within 30 days of selling their home. In that three years they were behind as much as a year. They didn't put their home up for sale in that time either. We let it pass about the down payment and let the late payments go for months at a time, thinking they were friends. They did catch up on the payments but never the late charges. They did sell their home a few weeks ago. I talked to them and made sure they remembered they owed us the additional $5000.00 within 30 days. They used their money to purchase another piece of land with a house on it. They also are using the money to completely gut the new home and rebuild almost from the ground up. A granet counter top, with new flooring and new bathroom fixtures along with all new appliances. Yet we have not gotten a penny of the $5000.00 that was suppose to be on the land contract we are holding. I want to foreclose but I am not sure what the procedures are here in the state of Michigan. I can't really afford an attorney seeing my husband was layed off after 28 years of work. We could use the money or we would like to re-sell the land. I read of a statutory foreclosure, the contract was not recorded other than they went to a local township hall to get the tax bill put in their name and forwarded to their prior address.
