Use of Trusts With Loss of AnonymityI observed today that when a deed of trust is created on a property held in trust, the deed of trust (very same book and page number) is indexed both in the name of the trust, and the trustee. I.e. the trustee of the land trust, is the trustor of the deed of trust... It appears then, that assuming you used a real name to act as trustee in a land trust, you should only buy and sell land (never refinance or take out new deeds of trust) if you want to keep that real name out of the index. What about the substitution of trustee in a JBB deal? Would this be a recorded substitution of trustee? Would you need to leave the trustee in the name of the ex-owner (who deeded his property into trust), in order to keep your name entirely out of the index? (It sounds like without an attorney or an LLC to act as trustee, much of the privacy protection of trusts can be lost.)
