Dealing with abandoned personal property...In Reply to: After an eviction posted by Jk on June 09, 2003 at 10:41 PM : What are the legal requirements in California for disposal of an ex-owners stuff that is left behind after a sherriff assisted eviction? =========== The care and final disposition of abandoned personal property is thoroughly covered by CA law. [Civil Code §§ 1980-1991] First you have to inventory the abandoned property and then store it as if it were your own property, keeping it dry and weather tight, and secure from being pilfered or stolen. You dont have to photograph the items but we do. We photograph everything in place, before moving it, so we can substantiate how everything was left behind and what was actually left behind. You must also give the assumed owner of the property a mailed notice that they have a right to reclaim their possessions within the following 15 days before you dispose of them in accordance with the above-cited statutes. This area of foreclosure is rife with costly legal disputes because many new owners-by-foreclosure presume they can cavalierly do anything they chose to with someone else's belongings, just because its been left behind temporarily.
