Re: Association ForclosureIn Reply to: Re: Association Forclosure posted by Rick Harmon on April 29, 2003 at 10:34 AM : Most HOA revised their CC&R's and ByLaws many years ago to permit recording and foreclosiing judicially on their liens like a TD. It's a rare Calif. association that has NOT made this change since they depend on the cash flow of all HOA members. Even so, since judicial foreclosures are a rare event, even a trickle of HOAs that have been reluctant to change could distort the distribution (percentage) of the types of plaintiffs, in the judicial foreclsoures. It's just a fact of human decision making, not even R.E. specific, that some people prefer avoiding change to converting to something better.
