Practice changes slower than law

Think about it. Ward has said the law changed about 10 years ago to allow nonjudicial HOA foreclosure.

Not all real estate attorneys, and certainly not all HOAs, stay on top of legislative changes. And even when they do, other people inherently "stick to what they know". Change comes slow to people's way of doing business.

Since judicial foreclosures are expensive and require legal expertise, most likely only a wealthy plaintiff (like a HOA) would bother with them.
