: ward,
: I have a small deed of trust,25,000 that ends up being ahead in time of recording of a much larger deed of trust of about 220,000. The 25k one is a HELOC.

: I could find no subordination or other evidence of the smaller not being senior. Was this just missed by the larger?

: thanks

Todd,

It?s tough to try to answer a question about priority without knowing if you?re an accomplished title searcher in your local county recorder?s office and without seeing the two documents, etc.

Is this a foreclosure situation? If so, you might be able to ask the foreclosing trustee or lender what the relative priorities are between the two trust deeds.

Anyhow, I?m sorry I can?t hazard a guess without more info.
