This board is focused towards F/C investors and the OP is clearly in that category, not a former homeowner licking their wounds from the loss of a home that they may or may not have been able to afford. This matter is, plain and simple, a discussion about lost profit opportunities. There's probably no one on this board who has been involved in more legal matters than myself as that has been my role until fairly recently, as a self-described "alligator wrestler." If the O.P. really thinks his case is strong enough and he wants to fight an uphill battle, then by all means have at it. On the other hand, I can think of a lot easier ways to make $100K without the hassles. JK said it well: "Never put your emotions in front of your money." If you do fight this thing to the bitter end, would you please enlighten us after this has concluded so that we may see your progress in fighting the good fight with an indifferent forclosure trustee and a lender who probably has a checkbox on some form for tort damages claims like this one.
