In CA, Courts only have control over commissions for court confirmed sales such as those under limited or special powers. In some juristictions, the county's public administrator auction their own sales internally however in some larger metro area like L.A. they contract, usually annually, with a real estate auctioneer/broker for the listing side. I think Kennedy-Wilson still has the L.A. contract. The Buyer's agent can typically participate in commissions, too. Otherwise, personal rep's are free to list with the agent of their choice. However, there's a lot of details to understand to both protect the listing agent's commission and get a deal sold and closed, especially if that agent has any difficulty with his/her client's capacity, powers and/or authority to sell.
