: Not at all. He's simply a tenant now. And the sheriff can't just throw him out, unless there is something diff. in CA laws. In fact, he can try to make some money out of it - cash for keys, it's called. Really.

If the sale was performed under his nose, perhaps he had a previous
sale date that was postponed due to short sale, however, whenever the
bank decides to place it in auction, they are not obligated to inform you
again. When the sale takes place, either the bank stays with it or a
an investor/buyer purchase it, in any event he can prolong his stay
and negotiate a keys for cash for 30 days for aprox $5,000. In any event
in order for the sheriff to get you out, the bank or buyer would have to
start an unlawful detainer which can go sometimes for 90 days, so
the bank or buyer is more interested in resolving it in 30 days
