: I was the winning bid at foreclosure auction on 10/26/09, Trustee's Deed recorded on 11/02/09 I've already served the 3 day Notice to Quit and found out today that the property owner (who is still in the property) filed for chapter 13 BK on 10/23/09 and the automatic stay is still in effect. How is this handled? Can I still file the unlawful detainer action, or should I try and get my money back from the Trustee? I really want to keep this one since I got it for $300,000 and property is worth about $450,000.
Property is in California in case that makes a difference
