Does anyone know the details of exactly where and when this event will take place? Rick, Form DE-160, Declaration of Representative, Guardian, Conservator or Small Estate, I think this is the Property Tax Certificate, there's 2 boxes A) no r.e. in CA & B) have been satisfied by filing change of ownership statement with county recorder/assessor of each county in CA. in which decedent owned property at the time of demise (death). When this form is filed and box (B) is checked, does'nt this prove that property has transfered with that person who has power to sell or is there additional document that has to be filed. And Letters of Testamentary gives proof that executor has power to sell unless will stipulates as long as decedent has surviving spouse (male/female) living in property and box #3 is checked with adendum stating that Executor cannot sell property as long as Mr. Mrs. XXX is still alive..
