How does the ability to Quit Claim a property to a 3rd party or a spouse affect the Trustee Sale if the orignal owner is still in Foreclosure but has Quit Claimed the property away? Thanks for your replies. : : Is it legal to Quit Claim a property to a third party despite still having the mortgage remain as is? My friend is in a deperate situation where she is about to lose her property and has no more time to sell it. I've offered to bring her current, and assume responsiblity of the property.
