Big boy court - UD is concerned only with landlord tenant issues. You have the deed. If they make this argument in UD court, move to have the judge exclude it on the grounds it is outside his jurisdiction. Have your lawyer research the following books:
(1) Landlord-tenant by the Rutter Group. This will give him current case law on the major points of your case. The judge will have this on the bench, and if you cite it, they will be on the same page.
(2) Eviction Defense Manual by CEB. This is written by a tenant's rights law group in San Fransciso and covers every possible argument to keep people in the houses without paying for it. Fortunately, it also covers how to overcome those arguments.
