: Sure, have the individual file another Chapter 13.

: We were chasing a foreclosure yesterday and discovered that the owner had filed "emergency filings" in Chapter 13 numerous times in the last year and each time it caused a postponement.

: Just tell your property owner that this time it won't ever go past the initial filing, so it will automatically die after the 15 day grace period passes without him filing the balance of the petition.

Todd, Is an emergency filing in Chapter 13 as simple as someone going down to the Bankruptcy court and filing or does an attorney have to file? Thank you in advance for your assistance. Reged Investments
