Legal fees become the mortgagor's responsibility

Is she responsible for the court costs and atty fees?

Yes.

If she can't afford to pay the fees what will happen?

The foreclosure process will continue culminating in an auction after which, your mom's rights to the property cease.

How long does a foreclosure take?

Although the process varies from state to state and from lender to lender, a general outline of timeframes can be accessed by clicking on the link to the left entitled '50 State Foreclosure Basics'.

Once she recieve the initial notice how long will she be able to stay in the house?

An agreement with the lender under forbearance will allow you get your loan back or track and avoid foreclosure.
