He's already went through the sheriffs auction, and he's now in the 6 month redemption period. I'm wandering if it's possible for us to buy the house? Her name is still on the mortgage, and the title. She gave him the house durring the divorce, but didn't get a quit claim deed. Does she have any rights? The foreclosure is showing up on her credit record, won't that destroy her credit as well? I would think she would have some right to the house am I wrong? Need help quick, the redemption period runs out in 2 months. =•=•=•=•=•=•=•=•=•=•= Jim, what document did your wife use to give her interest in her earlier house to her ex-husband? Was it recorded at that time? How do you know that your wife’s name is still on the title of the property? The fact that the foreclosure is also in your wife’s name means that she didn’t get the lender to remove her name from the now-defaulted loan at the time of her divorce. Since her name is still on the loan it will be reflected in the foreclosure of said loan. So yes, your wife’s credit will be adversely affected by the foreclosure. Your wife won’t have any right to any property uless her name is currently on title.
