I went through a nasty divorce several years ago and we had to file bankruptcy. We had a first and second mortgage; my ex left the area and refused to sign a power of attorney to put our house up for sale so the house was subsequently foreclosed on in the fall of 1999. The house was sold the following year. I'm thinking about buying another house in the future and I had a mortgage company check my credit report. They told me that a judgment was entered against us and is still on my credit report but the last report date was in October 2000. He also called FHA and they told him that the judgment was still on their records also. He told me that I might need to contact the mortgage company regarding this because if the judgment was satisfied, the mortgage company has to say so and that it may be my responsibility to get it removed because it isn't something that's automatic. I'm currently writing them a letter but my question to you is what do I need to do: will it do any good to contact the mortgage company; if the house has since been sold, why is the judgment still there (they can't get money twice for the same property, can they?); and what, if anything, can I do to get it removed - is it something I can do personally or will I need an attorney. Also, the mortgage person told me that if I can't get this cleared up, I can't get another FHA mortgage and the only option I have is a conventional mortgage with more money down (about 5%) and a high interest rate (about 10%). Is that true also? Thank you.
