: Property is going up for foreclosure and the auction is dated for Nov in NYS. I think that the owner is filing or has filed for bankruptcy. They have said that they would sell me their home before it goes up for sale. I have done a title search and there are no liens except for the mortgage. Can I still buy this from the owner or does bankruptcy pending affect my offer? Thanks.
Dick, since the owners initiated a voluntary filing they can file for a voluntary dismissal any time they want. Or they can stay in bankruptcy and get the judge or trustee to approve of the sale to you. Follow Ups: Post a Followup:
