Howdy,
I am actually in a reverse situation, similar to this one. I am 1 of 2 heirs.
A quick background involves my unmarried father dying without a will. In order to get
control of his assets, my sister and I aqquired Affidavits of Heirship for the state of Texas.
My sister decided to live in the house and continue paying the mortgage. As it stands, she has
not refinanced the home in her name and is now facing foreclosure. My questions involve being listed
as an heir and the impact on my personal credit with foreclosure because my sister insists that she
and I will not be affected. I think otherwise. What makes matters worse is that I live in
Georgia. Do I need to get an attorney in Texas? Do I need to take steps to remove my name from the
house completely, or am I free and clear?
