Re: Property Title TrustsIn Reply to: Property Title Trusts posted by B Beneteau on October 16, 2001 at 6:49 PM
: Ward: I have had a Family (A/B) Trust for 25 odd years. It is registered with the federal government, and all my RE holdings are in the Trust. In fact, I own nothing, everything is in the Trust. =•=•=•=•=•=•=•=•=•=•=•=•= Ben: Answer 1: Renaming the trust wouldn’t eliminate your name from the title if your name also remained as the trustee. It would probably work best if you just named a successor trustee, in the form of an LLC , as your new trustee. Answer 2: A trust itself is never recorded. And it doesn’t make sense to try to record a deed to property located in Orange County, CA in some other county in North Dakota. To have any force and effect a deed, trust deed, etc. would have to be recorded in the county where the property is located. Answer 3: And no, it really isn’t much help to have your trustee in some distant spot in the world, out of reach of our legal system. What I think is better is to have a local trustee because of the convenience but in the form of an LLC that doesn’t carry with it personal liability. Follow Ups: Post a Followup:
