If I did buy out the second, could I still record if the owner is in bankruptcy or would filing with the recorder after bankruptcy void out my interest. =•=•=•=•=•=•=•=•=•=•=•=•= Lisa, I’m going to assume that the owner of the 2nd hasn’t filed for bankruptcy, rather it’s probably the owner of the property that’s in bankruptcy, right? If my assumption is correct, then the sale of the junior bene’s interest and the recording of the assignment isn’t affected in any way by the bankruptcy of the property owner. Creditors can buy and sell their interests to one another at any time since such transfers don’t materially affect their debtors whatsoever. Hope I guessed right. Follow Ups: Post a Followup:
