Re: title holding trust and default purchaseIn Reply to: title holding trust and default purchase posted by Todd-wa on September 04, 2001 at 6:06 PM : Can using the title holding trust help avoid the transfer tax charged by my county/state when I buy from an owner in default and then flip it to the end user? ============ Todd, yes the trust can avoid the payment of the documentary transfer tax, but if thats all it did it wouldnt mean enough to anyone to go out of their way to use it. So in addition to your point, it also provides great anonymity of ownership, avoidance of probate, sidesteps the due on sale clause, avoids involuntary liens from attaching to title and insulates the title of investor property from the pecadillos of life (death, lawsuits, divorces, etc.).
