To the best of my knowledge, junior lienholders throughout the US have the legal capability to protect their interest by reinstating senior liens in default. If you are choosing to employ techniques not widely used by others in your area, spend the money on good local legal advice. Treat your investing as a business that you want to grow, not a way to make some quick money and if things go bad you'll just walk away. The thought of being able to leverage small amounts of capital into significant amounts of equity is tempting, I know, just make sure you do it in a fashion appropriate and legal for your area. Hope that helps, cause I can't do a "legal" answer.
