: We got a letter stating that we had until August 1st to catch up on our morrtgage or owners who carried partial contract will foreclose. My husband had surgery last year and was off work for three months and had to take a lower paying job for another 6 months to let his knee recouperate. We cannot catch up by that date. We have also recieved a phone call from our 1st holder that they intend to do the same if we aren't caught up with them by August 1st also. I am so stressed. We can catch up mostly but not all before then. HELP

TJ, it’s apparent that all you need is a reasonable respite to get caught up with your regular mortgage payments. If your lenders won’t voluntarily provide it you can impose it on them with the help of the federal government.

There is a special bankruptcy proceeding designed for individuals, such as yourselves, who need a little time to get back up to speed as far as their credit obligations are concerned. It is a Chapter 13 proceeding in bankruptcy. What it does is to force your creditors to agree to give you the time necessary to recuperate from your temporary setbacks and allow you to get on your feet once more.
