I need some advice QUICK!!I just purchased my very first home and took possesion exactly 3 weeks ago. This has been the nightmare from hell and just keeps getting worse. The day we moved in, we found HUGE amounts of black mold in the finished basement (this was completely hidden by seller's possessions). We did not have a whole-house inspection because we were drained from saving the down payment (I will never, ever buy a house again without a home inspection). We've had a professional mold remediation crew come in and give estimates.....$17,000!!!! That's just to remove the mold from the basement. That doesn't include rehanging the drywall and painting and putting the basement back to it's original finished condition. Also, there are air tests involved that cost $3,000 each. They will do an initial air test to determine if the mold is airborne. If so, they have to gut the whole house! I have gone back on the seller for this for failure to disclose. I couldn't even use my own attorney. I had to go out of town to get a real estate attorney because the seller is a "local-yocal" detective w/the State Police and he also sits on the county council. I have also gone back on the seller for "lying" on the disclosure. (The dishwasher doesn't work at all since day one and every single time it rains, rain pours down the chimney, runs all over the fireplace, through the floor, and down through the ceiling tiles in the basement and onto our furniture.) There's no way this seller lived here 16 years and this didn't happen to him! He said on the disclosure that he knew of no leaks. (By the way, he left a half-open box of ceiling tiles behind. This tells me that he concealed the water damage by constantly replacing the ceiling tiles). We moved in with absolutely no hot water, one shower completely broken, and now the other shower is leaking underneath and floods the bathroom! We have 6 rooms in the basement whose walls are all going to have to be knocked out for mold remediation. We are sueing the selling for "failure to disclose" and we will be vacating the property at the end of the month (I have already made my first mortgage payment and paid my Spring property taxes). We have no choice but to leave because my daughter has severe allergies, and I'm afraid she will get worse with so much black mold in the house. We don't even know if it's airborne yet. My question: What will happen when I vacate my house? Foreclosure is what I'm expecting. Will this financially ruin me for years and years? Will I ever be able to buy another house after this? What about offering "deed in-lieu of foreclosure?" Please, any advice regarding foreclosure that you can offer would be appreciated. I pay my bills so this is new for me. We are sueing the seller for a complete recision of the contract (he has to pay back all the money from the sale of the house, pay off the mortgage, and take back possession of the house).
