: Here's a theoretical situation. A HOA lien for $1,ooo is recorded 1/1/02. NOD and subsequent foreclosure recorded 4/1/02. Title search reveals no additional recorded HOA liens. The property is sold 8 months later at a trustee sale. Can the HOA Assn amend the lien to include the 8 months accumulation of fees and demand the new owner pay them? Or is the new owner only obligated to pay the original recorded HOA lien?

All foreclosure auctions allow the foreclosing creditor to amend and fix their final opening bid to cover exactly what is owed them up to the day of the auction sale. So why would a foreclosing HOA lien be any different?
