: I hold a 2nd note (purchased) on Nevada property. My note and the 1st both in default. My trustee recorded my NOD with the original beneficiaries shown as the bene's. My concern is that three months down the line someone will say this was improper NOD and we have to start all over. Should I be concerned? =•=•=•=•=•=•=•=•=•=•= Jim, Your trustee is correct in listing the original beneficiaries on the NOD rather than you, the successor beneficiary. The reason is that the county recorder’s records are accessed alphabetically. Therefore to match a currently recorded NOD with an earlier recorded deed of trust you have to recite in the NOD the original names on that deed of trust, because that’s the only way you can distinguish that deed of trust from any other.
