There properties in CA on leased land, not fee simple. The lender likely knew about that and made the loan subject-to the remaining term of the lease and naive bidder(s) didn't fully check condition of title.

What makes you think the land lease would go away?

I've made plenty of private money loans on leased land; usually near Palm Springs, Irvine or Huntington Beach. We just make sure that there's at least 10 years remaining on the lease beyond the maturity of our loan.

There's always something new and interesting to learn in this business.
