Easy one this time...In Reply to: Eviction + Belief of Abandonment posted by Jim on August 26, 2010 at 11:26 PM
Since it is apparent that the tenant has vacated you can secure the premises right now by changing the locks to prevent any squatter problem before your sheriff’s lockout occurs. Take photos or a video of all the rooms before you move any of her property. Once you have your Writ of Possession from the sheriff then switch the utilities in your name and inventory the “stuff” she left behind and send her your Belief of Abandonment of Personal Property form. Move her “stuff” off the property and into storage the same day you do the sheriff’s lockout.
: The process server informed me she told him she was in the process of moving out when he served her. I went to the property tonight to talk with her. Even though I am evicting her I still figured I could ask what her intentions are if she were around. There wasn't anybody home. I looked in the windows and it appeared to be vacated. I went inside for a quick peak to see what was going on (don't tell!) and it looks like she has moved out with the exception of a few items that may be trash. : Not sure what to do at this point. I still intend to go to the court house on Monday and get my clerk's judgment, but should I also file notice of belief of abandonment? If I do that tomorrow it will surely be faster than waiting on the donut chasers to get their butts over there for the lock out. Do I have to do the copper lock out if she is already gone or can I go straight there and change the locks? It has been just over 14 days since rent was due so I only have the 18 days to wait if I mail out the abandonment tomorrow. : I'm a little concerned that her scummy friends she started hanging out with might use it as a party pad. I kind of figured this was coming down the pike once I saw them hanging around. She turned her phone off (more likely it got shut off) and the emergency contact people on her app claim to not know where she is. The process server was told she was let go from work 2 weeks ago when he went there to serve her. : I have only had 1 eviction in 9 years and I have been reading Leigh Robinson's CA Eviction book which has been super helpful. : Thanks in advanced for any helpful posts. To those who respond with sarcastic remarks, I hope you step in dog doodie today and don't realize it until after you start driving around in your car. ;)
