It doesn't sound like your friend is that sophisticated, so why should his house be in such demand? Doubt if your friend hires an attorney. Exactly what/who is the opportunist? We need to know how he thinks he can get the house back for him or owner. If we knew the "how," we could probably shoot holes through it all day. Mostly likely it's more bravado than anything, and why would it be such a great deal/steal ($$$). Sure I could out bid for a house in this market for 110% or even 90% or 80%, but it may not be a great deal. If you're a realtor the way to make money in this situation is to contact the bank and try to get the listing. Shave the listing commission. If the deal is half as hot as you say you should be able to sell it without without a co-broker. Of course, the best opportunity was missed when no one bid at the TS.
