I've learn a bit more since my post. His objective was to file the BK to delay the bank from foreclosing on the property. BK filed was not by an attorney but someone that is a licensed by the DRE. This makes much more sense to me at this point. But now, a opportunist has emerged stating that will get his house back from Benne 99.9% without a court order. How is this possible? If this is possible, I will have customers lined up longer than the launch of the new iphone 5G. My advise to him was to hire a real attorney, gather all the goods from his house and move on.
