A recorded Memorandum of Option to Purchase is not a lien. It is merely a notice which contructively notices others by memorializing such an agreement. Then the question becomes: Does the optionee have any real equitible title which would be affected by a BK? I would think there are far better ways to achive stopping a F/C.
