Slow to produce trustee's sale deedsIn Reply to: Quality Loans says deed will be 14 BUSINESS DAYS after sale: posted by JK (the other JK) on July 13, 2010 at 3:13 PM 1. Primary Ramification is that the benefits of relationback aren't received. This is to say that the effect of the deed not being recorded timely precludes the buyer from the affect of a deed that would have otherwise be recorded as if recorded on 8 am on the date of the sale. 2. Don't recall specific statute regarding trustee's requirement to produce T.D.U.S. in any particular timeframe, nor damages for non-compliance. Might check case law citations. My gut tells me that we're barking up the wrong tree to expect trustees to provide faster service. Some are better than others, some are terrible. The one that I use has a horrible reputation for slow response, from everything from dropped bids on sale date to trustee's deeds (and everything in between). Pretty hard to legislate customer service levels although if damages can be shown, maybe there is some case law that could get an aggressive buyer a few bucks. However, trustee's move about the same way Government agencies do; not profit oriented at the service level. Ever thought of providing inexpensive incentives? Tix? Free dinner? Free Trip to Vegas (but they must listen to your timeshare pitch)?
