: It would not matter, the intent of both parties (you and the lender) is that both Deeds of Trust are entered into for the purchase of a home.

Well the plot thickens. Confirmed with the title company that the money went right from lender into escrow to the seller. They see the loans a's two side by side loans. One recording next to other. There's one record of settlement. With all of that being said it appears that both loans are/were in fact purchase loans. I guess my only worry being in ca is if the 580b doesn't protect me because the 2nd lender is not going to get anything. There won't be even 1.00 after the trustee sale for the second lender. And I just didn't want them to be able to say since you are upside down your second loan isn't secured by the property anymore. Ots secured by you personally. I don't want to get sued. IRS scary. I think I'm. Protected but I don't want want to mess up. I don't want to file bk
