Fred,

A bankruptcy petition that is filed after a trustee’s sale of a California property will not void the foreclosure auction, if the trustee’s deed is recorded within 15 days following the sale. [CA Civil Code §2924h(c)]

If a trustee's deed is recorded later than the 15 days following the trustee's sale then the new owner's title is determined to have vested on the later recording date.

: I have a client in California that lost her home at auction and someone told her that if she filed bankruptcy the following day she would be able to cancel the sale and go through the bankruptcy process. Is this possible?
