the lender cant complain about something he doesnt know about.

that is not to say that he would complain, anyways. or have any say-so.

he is still in first position, same as he always was.

after re-reading the OP's statement, i can now see the possible confusion, since it was worded badly.

being the lender that i am, i focused on the first half of the statement (buying a 2nd trust deed at an auction).

i guess what he really meant is what ward alluded to - he was buying a property with a 2nd trust deed on it.

he is not buying a note backed by a 2nd trust deed.

when i have foreclosed, being a second, i have never had a problem with the first allowing me to keep their loan current.
