Hi Kristine - I obviously Don't know all the real facts of this case either, but I would bet someone decided to file BK on the "partnership" which they believe exists as to the heirs' interests in the decedent's estate.

Interesting theory.

I've had administrators file BK on my loans a few times, but they alawys filed as to their individual interests, It's always been straight forward to get relief of stay and proceed with the t-sale.

Federal BK laws out-trump State/local probate laws, of course, however I wonder why the family this poster refers to didn't seek remedies available thru probate court?

Get spec admin appointed, stay of t-sale, order to sell or encumber, deal done.
