I ran into this in OC. Even took Ward's famed first student off gaurd. I still do not know how it occured but the consequence was that the homeowner lost apx 300K in equity. I'm wondering if it is possible for you to approach the homeowner of your auction to let them know of the irregularities. Maybe they could pick up the fight and get another auction rescheduled. This maybe beneficial to you and the homeowner...just not the slippery trustee.


: I ran into something I haven't experienced before. At the 10am auction in Riverside yesterday there were 40-60 people present from about 9:45 until I left at 2:30pm. 4-5 of us were interested in a particular property and repeatedly asked Angela the auctioneer for an update. Finally at 2pm she got a call that the auction had taken place that morning at 10am at the courthouse. Angela asked all present (about 50 people) if anyone had witnessed the other auction and not one person had seen it. Apparently the trustee (Lenders TD Service) sent their own auctioneer to the courthouse and even though the property was listed on Fidelity's website they had their auctioneer cry the sale. My questions are:

: Can a trustee send their own auctioneer to the sale?

: How loud do they have to cry the sale? Is it possible that 40-50 people were there and no one saw the auctioneer? (it's not a very big place)

: Do I have any recourse in getting them to re-auction the property?

: If the property sold for a penny over then a $500K house sold for approx $200K. I don't want to believe that something fishy happened I just don't know how they slipped under all of our noses and auctioned the property with no witnesses...
