Fighting with MY Lender

Ward I have a friend who I helped set his property in a title holding trust, he set his brother as trustee. He is very much un-side down in the loan (owes $385,000 worth about $115k). He received a letter in the mail (HAMP), which is a government program. Home Affordable Modification Program.
He has contacted his Lender and they are just giving him the run-a-round and are Not willing to respond. He wants to file a hard-ship letter with the bank seeing his Brother and Mother are moving out and getting there own place due to No-equity left in the house leaving my friend un-able to pay the current mortgage.
Our question is if he files a lis pending and suet against his “lender/servicing co.” would it be……Trust 123 bayview vs Lender. Having the Trustee as signing authority for the Trust(123Bay view) or does the original payee have to?
