Do they have an obligation to modify their loan?

If not, I'm not sure what else you could do on the legal front to 'enforce' such an action.

There are probably lots of ways that you can screw around with them, but who has the time.

This sounds more like one of those department of redundancy department situations where someone with bureaucratic powers has deemed the subject loan to be a junior lien so that's all they can see is a checkmark in box #111.

Maybe use the title research skills you learned from Ward and provide the loss-mit contact a diagram illustrating the title position (using stick figures might be a little bit over the top).
