You will have pay any outstanding city/county assessment liens before your sell or refinance. After the muni files the lien, if it goes unpaid, it will attach to the next property tax bill. This can get confusing for everyone in escrow when selling because the lien is both a recorded doc and may already be included in past due tax bills. I've probably paid 100 of these, and I've bought a lot less properties than that. That's the nature of working with distressed properties, especially vacant and/or abandoned ones.

Not only are the recorded liens yours to pay, but there could be others on the way. The muni sends a fix it letter to the last owner of record, then if no one acts, they then abate the problem and will eventually record a lien. You could see a new lien 3-6 months from now that was in the works before you bought the property.

I say this not to be negative, but to be careful with vacant properties that have obvious vandalism and/or look abandoned, as can sometimes be the case when buying at trustee's sale and a tax sale.


: I may not have been clear. I bought a property at the foreclosure action, the first deed of trust. There are leins Junior to that DOT, called "special assessment notice", they are by the City to recover admin. fines because the property violated use and condition codes. Do I have to pay these off?

: : The notice was for "administrative fines for violatons on the use or condition of the property". The notice says "this is a special assessment lien, and shall be collected in the same manner as municipal taxes".

: : Even though these violations (nusance) were after the SR. Deed of Trust, it sounds like they now have 'superpriority' because the city calls them a "special assessment". True?
