Abandoned property --> Lawsuit

Posted by Cyrus on February 22, 2010 at 5:19 PM

On the question of determining an abandoned property. I'd like to share my story here just so that it may be a lesson for the rest of us. This is all for educational purpose and not for ranting. If it does sound like ranting, I apologize and hope you try to see the lesson.

I have a trial coming up in 3 weeks on this matter (alleged forcefull eviction) and have spent over 30000 dollars on attorney fees by now. Why? because I bought a property that was abandoned and now the previous owner is claiming it was not. I don't know what feeds their push, greedy attorneys, anger, despair or what?

I followed Ward's instructions word by word:

- Give notice to enter premises, check
- Take photos of everything, check
- fridge full of rotten food, check (milk bottle dated 4 months prior to sale.
- No gas, check (i.e. no way to to take hot showers, cook a meal, do laundry in a condo, heat in winter, especially if you have a small child in the house)
- Trash all over the condo, check
- Allowed neighbors immediately after opening door to come and see the conditions.
- Gave a notice of abandonment and wait 18 days, check.
- Their 1st attorney acknowledged that there was no need for eviction since they didn't live there!

They are going full force after me despite all my photos and evidence, because they believe a jury will take sides with a crying blond mother against a tall dark and handsome ;) man (read big middle eastern guy).

Real life is very different from theory I guess.

In real life:
- the 1st attorney completely lied under oath to cover his retarded ass. Otherwise he'd be up for malpractice.
- Previous owner probably gets friends and other neighbor "friends" (f-buddies)to come and lie that they even stayed with her over night.
- Neighbors who saw the unit and were happy to see a new owner fix up the place and stop the high male visitor traffic and drug use on the balcony, now don't want to get involved and claim they don't remember anything.

I really would like to know if their new attorneys are paid or contingency. They think they have a great case and I simply don't understand how they could pile up lies and believe they can get away with it.
