Re: Serving occupants after trustee sale.In Reply to: Serving occupants after trustee sale. posted by Bob on January 29, 2010 at 7:32 PM : We have always waited until we record TDUS before we serve occupants, however I noticed that FNMA serves day after sale and they state in their initial contact form that they are the new owners. (Confirmed) : Are they correct in stating they are the new owners the day after the sale even though they have not recorded the TDUS. : We could save weeks if we could start the process this quickly. We were concerned that the occupants could challenge the validity of the serving when we are in court and force us to re start the process if we served them prior to recording deed. We defend these all day long against bank REO foreclosures. Wait until after the Trustee's Deed is recorded or you draw a demurrer, which drives up the attorney fees and costs you between 10-15 days in the eviction process.
