From what I heard from the sheriff, the judge did assign someone to the task on this guy. I'll put up the TRO on a website if you folks are interested to see it. The federal case does exist and we are named as defendants along with the lender, trustee etc (never served) but the TRO does not exist. And I still like to think the judge, the assistant or the sheriff made a mistake. I mean, why would any real attorney do such a thing. I have his business card, so I'll post his name if interested.

Ward, Can you send me or post the TRO. You mentioned that you would put up the TRO on a website if anyone was interested to see it and then in the next sentence state "...but the TRO does not exist." I have to agree with wanting to think it was a mistake. I say this because Thurman did the proper procedure to halt my eviction and move it to federal court but now.... I have no attorney and I'm in the middle of litigation. The FBI, and the local authorities, and the ABA and CALBAR are all proud of the great job they did in arresting a couple of attorneys and no mention of the client who is a homeowner with children who is now facing homelessness. There is no mention on the internet or sent to our homes giving notice and what resources we have available to us. Not a single word of how to get our case file. No consideration to budget a small amount of funds in their nation wide project to provide emergency assistance to the attorney's clients in filing a substitution of attorneys, in knowing about the case, in directing clients to their case file, etc... I was notified the week prior to christmas that my case was pending dismissal and stayed until the 24th of Jan. I'm sure other clients involved in lender litigation don't have yet another $5k plus to hire yet another crooked attorney. I personally think the banks are behind this in some form. Timothy Thurman had impeccable credentials, top of his class, and provided services without upfront payment. I think there must be a mistake but regardless, the forces behind the seek and stompout mortgage modification fraud can be lumped with all the other service companies that committed the fraud. The real estate and mortgage industry corruption migrated to loan modification and short sales by the same people. The banks handed out the mortgage loans and controlled the appraisals migrated to the bailout money and foreclosed anyways. Now the focus and money is in pointing the finger and making them all pay all in the name of "protecting the homeowner". Protecting the homeowner by taking away the attorny so now the bank won by default and gets to keep the home as they kick back and let the government handle the job by knocking out the only wall that the client was protected by. I really believe the banks are targeting the attorneys who knew the law and had many cases in court. I know in March, Thurman had almost 28 pending cases against wamu for various things like fraud, civil rights, breach of contract, and more. I truely believe that Thurman was an ethical attorney who cared enough to take the case without upfront payment to keep a single mother with grade school kids from being homeless. There are probably people that are reading this and thinking why did she get into a mortgage she couldn't afford, and all those other negative pesamistic ways of thinking. I owned my home for about 11 years and was making two extra payments each year. My loan was an adjustable and it was great since it had a cap of 9%. I was sold a loan where the payment was to adjust after the first year but wamu adjusted after the first month and then again after the first year. I tried to get that resolved but eventually ate it and was still happy with my adjustable arm. The rate adjusted daily except wamu adjusted multiple times a day and then failed on other days. One time each year the payment was to adjust based on certain things and wamu didn't follow the contract and on the 5th year when the loan was to readjust, my interest rate jumped to over 8% although the rate should have been set somewhere around 5.5%. The rate was to have adjusted daily but did not. I called to resolve the problem and went into a modification senerio. After approval, wamu foreclosed on my home and I had no notice. And it went on from there with being blocked from contacting anyone in wamu after entering a loan number and without that, you will get a rep who will find your loan number and then route you to a dead end extention.
