Rick raises an excellent point. No I am not certain that this will
not cloud title. I simply believe it will not cloud title. I do
not have Rick's extensive experience in these matters, but I do have
a decent relationship with my title company. I would suggest that you
work with your title company, or maybe even a different title company
if that doesn't work, to get a commitment from them to issue a
policy without this lien as an exception. Any yahoo can file a lien
against a property they don't own, but a title company worth their
salt will be able to deal with it without a quiet title action. That is,
in my opinion (no case law cited as on point).
