He's a tenant in a foreclosed property so I wouldn't skip this step just in case things change and/or don't turned out as planned. Then right after that I'd do the 3 day quit or pay. If he pays, you've got rent, if he doesn't you go forward. But your 90 day termination stays in place. As for cash for keys, how much did you offer? My experience is that cash for keys will be rejected if it doesn't replace 3 months rent. Many tenants need 1st, last, and deposit, plus moving. Even then, tenants without credit or cars, etc., have a hard time moving. I suggest really looking at what cash for keys would mean to you and see if you can motivate the tenant with real moving money.
