If it's showing up in your prelim, call and ask the assigned title officer if it's an issue. Hopefully, your contract stated clear and marketable title. And no, you as the buyer don't pay for those things unless you contracted to do so. Also, if your seller bought that property less than a year ago, you may need special title insurance. CA title companies don't insure re-sales on tax sale within the first 12 months after sale.
